1. Service Provider

This website and the Client Portal are operated by Roman Babakin, registered as an Individual Entrepreneur (P/E Roman Babakin) in Georgia.

2. Scope of Services

I provide custom software development, platform engineering, and related technical services on a subscription or project basis. The specific scope, deliverables, and commercial terms for each engagement are defined in a separate Service Agreement between me and the client.

This document governs the use of the website (rmnbb.com) and the Client Portal. By accessing either, you agree to these terms.

3. Client Portal

The Client Portal is a secure, authenticated workspace for managing active engagements. It provides project tracking, file sharing, event history, and direct communication between the client and me.

3.1 Legal Standing of Portal Communications

All communications exchanged through the Client Portal — including messages, comments, file uploads, project updates, and event records — are logged, timestamped, and stored as part of the engagement record. Unless a separate Service Agreement explicitly states otherwise:

  • Portal communications and email correspondence constitute valid written communication between the parties and may be referenced in formal agreements and disputes.
  • Approvals, confirmations, and change requests made through the Portal carry the same weight as equivalent communications made via email.
  • Documents uploaded to the Portal (specifications, briefs, reports) are considered accepted by both parties unless objected to in writing within 5 business days.

This framework is designed to reduce administrative overhead while maintaining a clear, auditable trail of decisions and deliverables.

3.2 Access and Credentials

Portal access is granted to authorized users only. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Intellectual Property

All content on this website — including text, images, case studies, and code examples — is the intellectual property of Roman Babakin unless otherwise stated.

Ownership of deliverables produced under a client engagement (source code, designs, documentation) is governed by the applicable Service Agreement. In the absence of a specific agreement, all intellectual property created during the engagement transfers to the client upon full payment.

5. Data & Privacy

5.1 What Data is Collected

  • Account data: Name, email address — provided during registration.
  • Portal activity: Messages, files, project events — created by you during the engagement.
  • Technical data: IP address, browser type, page visits — collected automatically for security and analytics.

5.2 How Data is Used

  • To provide and maintain the service you engaged for.
  • To communicate with you about your projects.
  • To detect and prevent security incidents.
  • To improve the platform based on aggregate usage patterns.

I do not sell, rent, or share your personal data with third parties for marketing purposes. Third-party services used in operations (hosting, email delivery, analytics) process data only as necessary to provide their function.

5.3 Data Retention

Project data (files, messages, event history) is retained for the duration of the engagement and for 12 months after its conclusion, unless a longer period is required by applicable law or agreed upon in writing. You may request data export or deletion at any time by contacting me.

5.4 Cookies

This website uses essential cookies for authentication and session management. Analytics cookies (Google Analytics) are loaded only after your explicit consent.

6. Confidentiality

All project materials, business information, and communications exchanged during an engagement are treated as confidential. I will not disclose, publish, or use client information for any purpose outside the engagement without explicit written consent.

Case studies published on this website are created only with the client's approval and may use anonymized details where requested.

7. Limitation of Liability

Services are provided on a best-effort basis. I am not liable for indirect, incidental, or consequential damages arising from the use of the website, the Client Portal, or any deliverables — including but not limited to loss of profits, data, or business opportunity. Total liability under any engagement is limited to the fees paid during the preceding 3-month period.

8. Changes to These Terms

I reserve the right to update these terms. Material changes will be communicated to active clients via email or Portal notification at least 14 days before taking effect.
